Since the German Mediation Act came into force in 2012, Section 253 (3) of the Code of Civil Procedure (ZPO) requires every statement of claim to indicate whether an out-of-court attempt was made or why it was not.

Conciliation Procedure (State-Approved)

Legal certainty when limitation periods are approaching. If a claim is close to becoming time-barred, initiating the state-approved conciliation procedure immediately suspends the limitation period. The procedure also offers the opportunity to reach an amicable settlement that can be made directly enforceable.

Mediation

Mutually agreed solutions instead of litigation. In mediation, the parties develop their own solution options with the support of a neutral mediator. Conciliation (with Recommendation)

Structured guidance for a workable agreement. In conciliation with recommendation, a neutral conciliator reviews the case, guides the discussion and prepares a written, professionally reasoned recommendation.
