31.12.2022: Application for conciliation has the effect of suspending the limitation period

A timely conciliation application before 31.12.2022 effectively and inexpensively suspends the limitation period for claims and can be submitted simply by fax or beA.

By 31.12.2022, a large number of potential claims are once again at risk of becoming time-barred. An effective and inexpensive way of suspending the limitation period for claims is to initiate conciliation proceedings before a state-recognized dispute resolution body (also known as a conciliation office). If the application for conciliation is received by a state-recognized dispute resolution body before the end of 31.12.2022, the limitation period for a claim can be suspended. An application for conciliation can be submitted by fax or via a lawyer using a special electronic lawyer’s mailbox (beA).
