ROLAND Rechtsschutz Versicherungs AG recently published its 2018 Legal Report. Once again, the authors come to the conclusion that awareness of the mediation process is gradually increasing. While 69% of the population had heard of mediation procedures in 2016, this figure had risen to 73% just one year later. And almost half of the population (49%) rate the chances of success of a mediation procedure for amicable dispute resolution positively.
Although these figures are optimistic, in practice the demand for mediation procedures can still be increased. One reason for the restrained demand is probably that lawyers predominantly prioritize going to court as the means of choice for resolving disputes. Particularly in commercial disputes, which are often based on longstanding contractual relationships, lawyers should rather see themselves as conflict managers for their clients and work together with the parties to find amicable, economically viable solutions with the help of professional mediators.
It’s worth a try, as an out-of-court mediation procedure directly contributes to legal peace and ultimately increases its popularity and acceptance in Germany.
