In the dispute over the construction of a surgery center for the Düsseldorf University Hospital, the Düsseldorf Regional Court has recommended mediation to the parties involved. A process could take years, as the conflict is very complex.
The court is thus making use of the statutory option under Section 278a (1) of the German Code of Civil Procedure (ZPO) to suggest mediation or another out-of-court dispute resolution procedure to the parties in complex commercial disputes.
Extensive business conflicts are often very multifaceted and characterized by distribution disputes, questions of principle or value as well as strategy conflicts.
With the help of qualified mediators, the parties have the opportunity to independently work out an amicable solution to the conflict in a structured process. Mediation procedures take place in private, protecting sensitive data and the company’s reputation. Due to the usually significantly shorter duration of the proceedings compared to court proceedings, the parties can also save direct and indirect (procedural) costs.
