Until now, CenaCom’s rules of procedure stipulated that conciliation applications, which are also intended to suspend the statute of limitations, had to be submitted by post or fax. The advancing digitalization of legal transactions and the growing need for fast and legally secure procedures have prompted CenaCom to now also accept conciliation applications by beA (special electronic lawyers’ mailbox) or by e-mail.
The application to initiate conciliation proceedings can also be submitted via beA to the P.O. Box address of attorney Oliver Boltze as managing director of CenaCom. If the application is to be submitted by e-mail, care should be taken to use a common file format (preferably pdf). However, if the limitation period of a claim is to be suspended or another legal consequence of the appeal to the conciliation office is to be achieved, a qualified electronic signature must be used. Further details can be found in the Rules of Procedure as of 10.04.2022.
