Strategic tool for lawyers: Why the conciliation office is not a competitor

As a strategic tool, the state-approved conciliation office strengthens lawyers' sovereignty, speeds up proceedings, and creates secure, confidential, and efficient solutions for clients.

In modern legal consulting, the requirements profile for lawyers has changed fundamentally. Clients from the business world no longer measure the success of a law firm solely by its procedural dominance in court, but by the efficiency and value of the solution to the problem. In this context, the state-recognized conciliation office is often mistakenly perceived as competition for traditional lawyers. In fact, however, it represents a procedural resource that significantly expands a lawyer’s strategic repertoire and strengthens client loyalty through faster successes.

Cooperation instead of confrontation

The involvement of a state-approved conciliation body does not mean that legal expertise is dispensed with. On the contrary. The lawyer remains the strategic head of the proceedings. While the conciliation body provides a neutral, legally secure framework and acts as moderator, the lawyer concentrates on the legal enforcement of the client’s interests and the drafting of the settlement.
This form of cooperation enables law firms to resolve complex commercial disputes that are often blocked for years by state courts. The conciliation body acts as an accelerator, allowing the lawyer to deliver results while competitors are still waiting for the first court date.

The security of the court order

A major reservation about out-of-court settlements is often the misconception that settlements reached before a state-recognized conciliation body are not enforceable. This is not the case. Here, the state recognition of the conciliation body provides the decisive legal leverage. According to Section 794 (1) No. 1 of the Code of Civil Procedure, a settlement concluded and recorded before such a body is equivalent to a final court judgment.

For legal practice, this means maximum security:

  • Immediate enforceability: The client receives a document that can be used immediately to enforce the judgment.
  • Avoidance of liability: By using a legally prescribed, state-legitimized procedure for suspending the statute of limitations (Section 204 of the German Civil Code (BGB)) and obtaining a title, the lawyer fulfills the highest duties of care.
  • Legal certainty: The formal rigor of the conciliation procedure protects the outcome from subsequent challenges and creates definitive legal peace.

Efficiency as an economic factor for law firms

There is also a business logic behind the use of a conciliation office for the law firm itself. Lengthy proceedings involving several instances often tie up a disproportionate amount of time in file management and appointments in relation to the amount in dispute.
The conciliation procedure allows for a higher rate of successfully completed mandates. The lawyer’s remuneration is also based on the Lawyers’ Fees Act or individual fee agreements, whereby the settlement fee can often be realized more quickly and with less procedural risk. In addition, the law firm positions itself as an innovative advisor that places the client’s economic interests, namely time savings and confidentiality, above the mere conduct of litigation.

Strategic course setting: discretion and control

Another aspect that lawyers can use to their clients’ advantage is the preservation of confidentiality. In a public court proceeding, there is always the risk that sensitive business secrets or internal strategies will become part of the record. The confidentiality of conciliation proceedings allows lawyers to develop solutions that would not be possible in a public courtroom.
In addition, the lawyer and client retain full control over the outcome of the proceedings. Unlike a judgment handed down by a third party, the outcome of conciliation proceedings is the product of active legal representation.

Synergy for client success

The involvement of a state-approved conciliation body is therefore not a sign of weakness, but rather proof of procedural sovereignty. Lawyers who actively integrate this tool into their strategy offer their clients measurable added value: legal force without the inertia of the apparatus, security without the risk of publicity, and success through professional cooperation in out-of-court dispute resolution for the client.
